Terms of Service

These Terms of Service (“Terms”) govern reservations made through websites and booking experiences operated or managed by JBC VACATIONS INC., DBA Ohana Vacations, that link to these Terms.
Please read these Terms carefully before completing a reservation.
By completing a reservation, including by clicking the button to finalize a booking, you agree to these Terms and to the reservation-specific rates, cancellation policy, payment conditions, property rules, and other material conditions disclosed in connection with your reservation.
1. About Ohana Vacations and the Property
“JBC Vacations,” “Ohana Vacations,” “we,” “us,” and “our” refer to JBC VACATIONS INC., DBA Ohana Vacations, when acting in connection with the applicable reservation.
JBC Vacations provides reservation, management, and hospitality services for properties that may be independently owned or operated.
Depending on the property, JBC Vacations may act as an owner, operator, manager, booking agent, or service provider on behalf of the applicable property owner or lodging operator.
The accommodations associated with your reservation may therefore be provided by an independently owned property or another lodging entity.
References in these Terms to the “property” include the hotel, inn, motel, lodging establishment, guest room, and related premises associated with your reservation.
2. Terms Governing Your Reservation
Your reservation is governed by:
These Terms;
The property, room or accommodation, dates, occupancy, rate, taxes, fees, and other details shown during booking;
The cancellation and refund policy applicable to the reservation or rate selected;
Any material property-specific conditions disclosed in connection with the reservation; and
Reasonable safety and operational rules applicable to the property.
If a reservation-specific term directly conflicts with a general provision of these Terms, the reservation-specific term controls for that reservation.
You are responsible for reviewing reservation details before completing your booking.
3. Eligibility and Responsibility for the Reservation
You must have legal capacity to enter into a binding agreement.
Any minimum-age requirement applicable to a property will be disclosed through the property listing, booking process, or reservation materials.
The person making the reservation is responsible for:
Providing accurate reservation information;
Making required payments;
Complying with these Terms;
Ensuring guests and visitors associated with the reservation comply with applicable property rules; and
Charges or obligations properly arising from the reservation.
You may not use false information, impersonate another person, or use a payment method you are not authorized to use.
4. Reservation Confirmation
A reservation is confirmed when you receive confirmation from us or from the booking platform through which the reservation was made.
You are responsible for reviewing the confirmation and promptly notifying us of any apparent error.
Availability, rates, taxes, fees, restrictions, and policies may vary by property, room, date, booking channel, and rate plan.
5. Rates, Taxes, and Fees
You agree to pay the rates, taxes, fees, and other charges disclosed in connection with your reservation.
Charges may include, where applicable:
Lodging charges;
Applicable taxes;
Pet fees;
Parking or amenity charges;
Additional guest charges;
Deposits;
Optional services or add-ons; and
Other charges disclosed before booking or separately authorized by you.
Unless otherwise stated, rates and availability may change until a reservation is confirmed.
Obvious pricing or technical errors may be corrected.
If a confirmed reservation is affected by a material pricing error, we may contact you and offer reasonable options, including accepting the corrected price or canceling the affected reservation with a refund of amounts paid for accommodations we cannot provide at the confirmed price.
6. Payment Authorization
By providing a payment method, you represent that you are authorized to use it.
You authorize JBC Vacations, the applicable lodging provider, and their payment processors, as applicable, to charge the payment method associated with the reservation for:
Amounts due at booking;
Scheduled or remaining payments disclosed in connection with the reservation;
Taxes and disclosed fees;
Changes, extensions, or additional services you authorize; and
Other amounts properly chargeable under these Terms.
If a required payment cannot be processed, we may request another payment method.
Failure to make required payment may result in cancellation, subject to the policies applicable to the reservation.
7. Cancellations, Changes, No-Shows, and Refunds
Each reservation is subject to the cancellation and refund policy disclosed for the reservation or rate plan selected.
By completing the reservation, you agree to that policy.
Policies may vary by:
Property;
Rate plan;
Booking channel;
Length of stay;
Dates or season; or
Promotional terms.
Some rates may be partially refundable or non-refundable.
Unless otherwise required by law or provided by the applicable reservation policy:
Cancellation after the applicable deadline may result in partial or complete forfeiture of amounts paid or due;
A no-show may be treated as a cancellation after the applicable deadline;
Early departure does not automatically entitle a guest to a refund for unused nights; and
Reservation changes are subject to availability, current rates, and applicable policies.
Reservations made through third-party booking platforms may also be subject to the platform’s procedures.
8. Property Unavailability or Material Changes
Circumstances may occasionally make a reserved room or property unavailable or materially unsuitable for occupancy, including significant maintenance failures, property damage, safety concerns, government restrictions, or other circumstances outside reasonable control.
Depending on the circumstances, we or the applicable lodging provider may:
Offer alternative accommodations;
Offer different dates;
Provide a mutually agreed credit;
Cancel the affected portion of the reservation and refund amounts paid for accommodations that cannot be provided; or
Offer another reasonable remedy.
Except where required by law, neither JBC Vacations nor the applicable property is responsible for consequential expenses or losses arising from circumstances outside reasonable control.
9. Check-In and Checkout
Guests must follow the check-in and checkout times and procedures applicable to the property.
Check-in may require:
Completion of required payments;
Verification of reservation or identification information;
A valid payment method;
Compliance with age requirements; or
Satisfaction of other reasonable requirements disclosed for the stay.
Guests must vacate accommodations by the applicable checkout time unless a late checkout is authorized.
Unauthorized early arrival or late departure may result in reasonable additional charges where disclosed or permitted by law.
Keys, key cards, codes, and other access credentials must not be shared with unauthorized persons.
10. Occupancy and Guest Conduct
Occupancy must comply with applicable property limits and reservation terms.
The primary guest is responsible for the conduct of guests and visitors associated with the reservation.
Guests must treat:
The property;
Other guests;
Employees and contractors;
Neighboring properties; and
Property equipment and furnishings
with reasonable care and respect.
Illegal activity, dangerous conduct, intentional damage, harassment, threats, excessive disturbances, or serious violations of property rules are prohibited.
11. Property Rules
Guests must comply with applicable property-specific rules.
Rules may address matters including:
Smoking or vaping;
Pets;
Noise and quiet hours;
Visitors;
Parking;
Maximum occupancy;
Pools, hot tubs, fireplaces, or other amenities;
Security and access; and
Other reasonable safety or operational requirements.
Material restrictions and charges applicable to the reservation should be disclosed in connection with booking or the stay.
12. Refusal of Service or Termination of Stay
To the extent permitted by law, check-in may be refused or a guest may be required to leave when reasonably necessary because of:
Fraud or material misrepresentation;
Failure to make required payment;
Serious or repeated violation of these Terms or property rules;
Unauthorized occupancy or disruptive events;
Illegal or dangerous activity;
Threatening, harassing, or abusive conduct;
Material property damage;
Conduct creating an unreasonable safety risk or substantial disturbance; or
A lawful order requiring removal.
Refund eligibility following termination depends on the circumstances, applicable law, and the reservation’s cancellation and refund terms.
Nothing in this section permits unlawful discrimination.
13. Damage and Additional Charges
Guests are responsible for damage, loss, or extraordinary cleaning costs caused by the primary guest, members of the guest’s party, visitors, or animals associated with the reservation, beyond ordinary wear and tear.
Where permitted by law and supported by the circumstances, the payment method associated with a reservation may be charged for reasonable amounts resulting from:
Property damage;
Missing or destroyed property;
Excessive cleaning;
Unauthorized smoking;
Unauthorized pets;
Lost or unreturned keys or access devices;
Charges imposed on the property as a direct result of a guest’s violation; or
Other reasonably documented losses for which the guest is responsible.
Damage or violations may be documented using photographs, video, invoices, inspection reports, communications, or other reasonably available evidence.
Guests will not be charged for ordinary wear and tear.
14. Maintenance, Amenities, and Property Conditions
Properties vary in age, design, location, furnishings, and amenities.
Reasonable efforts are made to maintain accommodations and provide materially represented amenities, but temporary interruptions or failures can occur.
Guests should promptly report significant maintenance, cleanliness, safety, or amenity concerns and provide a reasonable opportunity for the issue to be investigated and addressed.
Temporary interruption of internet service, utilities, appliances, pools, hot tubs, climate systems, or other amenities does not automatically create a right to a full refund.
Any remedy depends on the nature and duration of the problem, its effect on the stay, the ability to correct it, applicable reservation terms, and applicable law.
15. Safety and Personal Responsibility
Travel and lodging involve ordinary risks.
Properties may contain features such as:
Stairs;
Balconies;
Pools or hot tubs;
Fireplaces;
Parking areas;
Natural terrain;
Water; or
Other conditions requiring ordinary care.
Guests are responsible for exercising reasonable care and supervising children and others requiring supervision.
Nothing in these Terms waives liability that cannot legally be waived.
16. Personal Property
Guests are responsible for safeguarding money, vehicles, luggage, electronics, valuables, and other personal property.
To the fullest extent permitted by law, JBC Vacations and the applicable property owner or lodging operator are not responsible for loss, theft, or damage to personal property except where liability cannot legally be excluded.
Lost property may be handled according to applicable property procedures.
Shipping, storage, or handling charges may apply when lost items are returned.
17. Events Beyond Reasonable Control
We and the applicable lodging provider are not responsible for failure or delay caused by circumstances beyond reasonable control, including:
Severe weather;
Natural disasters;
Wildfires;
Flooding;
Government orders;
Widespread utility or communications failures;
Transportation interruptions;
Public emergencies; or
Similar extraordinary events.
Available remedies depend on the reservation terms, applicable law, and circumstances.
Travel insurance is encouraged where a trip involves significant non-refundable expenses or risk of disruption.
18. Communications and Electronic Records
You agree that reservation confirmations, receipts, policies, notices, disclosures, and other transaction-related communications may be provided electronically.
Reservation-related communications may include information necessary to:
Confirm or modify a reservation;
Collect or confirm payment;
Provide arrival or access instructions;
Communicate during a stay;
Address safety or maintenance matters; and
Follow up concerning checkout, lost property, damage, refunds, or other reservation matters.
You are responsible for providing accurate contact information.
19. Website Use and Intellectual Property
You may use our websites for lawful personal and travel-related purposes.
You may not:
Attempt unauthorized access to our systems;
Interfere with website operation or security;
Introduce malicious code;
Use websites for fraudulent or unlawful activity;
Impersonate another person;
Make fraudulent reservations; or
Misuse reservation, pricing, promotional, or payment systems.
Website content, including text, photographs, graphics, logos, and other material, is owned by or licensed to JBC Vacations, the applicable property, or another rights holder and is protected by applicable law.
20. Website and Listing Information
Reasonable efforts are made to provide accurate property descriptions, photographs, availability, pricing, and other information.
Minor differences may occur because of renovations, maintenance, replacement furnishings, seasonal conditions, photography, or other changes.
Material changes affecting a confirmed reservation will be addressed in accordance with these Terms and applicable law.
21. Limitation of Liability
Nothing in these Terms excludes or limits rights, remedies, warranties, or liabilities that cannot legally be excluded or limited.
To the fullest extent permitted by law, JBC Vacations, applicable property owners and lodging operators, and their representatives will not be liable for indirect, incidental, special, or consequential losses arising from:
Circumstances outside reasonable control;
A guest’s conduct or negligence;
Violation of these Terms; or
Misuse of a property.
These Terms do not limit liability for fraud, willful misconduct, or other liability that applicable law does not permit to be waived.
22. Privacy
Our handling of personal information is described in the Privacy Policy linked through the applicable booking experience.
23. Changes to These Terms
We may update these Terms from time to time.
The Terms applicable to a reservation generally will be the version presented or made available in connection with that reservation, together with the reservation-specific terms and policies applicable at booking.
24. Severability and No Waiver
If a provision is found unenforceable, it will be enforced to the maximum extent legally permitted or severed as necessary, and the remaining provisions will remain in effect.
Failure to enforce a provision on one occasion does not waive the right to enforce it later.
25. Applicable Law
These Terms and each reservation are subject to applicable federal, state, and local law.
The law applicable to a particular dispute may depend on the location of the property, the entity providing the accommodations, applicable consumer-protection law, and other legally relevant circumstances.
Nothing in these Terms is intended to deprive a consumer of mandatory legal rights.
